Petition for Variance
Emergency Petition for Waiver of Rule 64J-1.0201(3)(a)5, F.A.C.
NOTICE IS HEREBY GIVEN THAT on September 7, 2010, the Florida Department of Health, Division of Emergency Medical Operations, Bureau of Emergency Medical
Services (EMS), received an emergency petition for waiver of Rule 64J-1.0201(3)(a)5, Florida Administrative Code, from Henry J. del Valle on behalf of
Florida Keys Community College.
Nature of Rule: Sets forth the minimum qualifications for Program Directors at Florida-approved EMS Training Programs. To be eligible for approval as an
EMS Training Program, applicants must provide documentation that a Program Director has met the standards for their position as listed in the school's
Application for Approval of an Emergency Medical Services Training Program, DH Form 1698, December 2008.
The petitioner, who meets all other requirements, is requesting a waiver of the requirement of two years teaching experience as a Level B instructor in
the above-described rule to allow him to serve as Program Director.
All comments regarding this emergency petition must be received in writing by September 27, 2010.

Emergency Petition for Temporary Variance of Rule 64J-1.0201(3)(a)(2), F.A.C.
NOTICE IS HEREBY GIVEN THAT on August 30, 2010, the Florida Department of Health, Division of Emergency Medical Operations, Bureau of Emergency Medical
Services (EMS), received an emergency petition for variance of Rule 64J-1.0201(3)(a)(2), Florida Administrative Code, from the School Board of Manatee
County, Florida.
Nature of Rule: Sets forth the minimum qualifications for Program Directors at Florida-approved EMS Training Programs. To be eligible for approval as
an EMS Training Program, applicants must provide documentation that a Program Director has met the standards for their position as listed in the school's
Application for Approval of an Emergency Medical Services Training Program, DH Form 1698, December 2008.
The petitioner is requesting a temporary variance of the above-described rule through and including June 30, 2011 to allow an instructor, who meets
all other requirements, to act as Interim Program Director while completing his Bachelor's degree as required in the rule.
All comments regarding this emergency petition must be received in writing by September 24, 2010.

NOTICE IS HEREBY GIVEN THAT on June 1, 2010, the Florida Department of Health, Division of Emergency Medical Operations, Bureau of Emergency Medical
Services (EMS), received an emergency petition for variance of Rule 64J-1.0201(4)(a),(d) and (e), Florida Administrative Code, from Fortis Institute FKA
Florida Career Institute.
Nature of Rule: Sets forth the minimum qualifications for Adjunct Instructors at Florida-approved EMS Training Programs. To be eligible for approval as
an EMS Training Program, applicants must provide documentation that each instructor has met the standards for their position as listed in the school's
Application for Approval of an Emergency Medical Services Training Program, DH Form 1698, December 2008.
The petitioner is requesting a temporary variance of the above-described rule until January 1, 2013 for any newly hired instructors to meet the Instructor Core Curriculum or exemption requirements.
All comments regarding this emergency petition must be received in writing by June 23, 2010. As of this notice, the Department has not determined
whether this petition should be treated as an emergency petition.

- Changes to Proposed Rules - Neonatal Transports
Note: Pursuant to Chapter 120.54(3)(d), F.S., changes to a proposed rule must be supported by the record of public hearings held
on the rule, must be in response to written material submitted to the department within 21 days after the publication of the Notice of
Proposed Rule, or must be in response to a proposed objection from the Joint Administrative Procedures Committee.
Chapter 401, F.S.
- The above version of Chapter 401, F.S., includes the following amendments from the 2009 Legislative Session which were approved by Governor
Crist on June 16, 2009.
- s. 401.2701, F.S. - revising requirements for the field internship experience in paramedic programs and authorizing the Department of Health to
adopt rules
- s. 401.281, F.S. - revising the documented requirements for a driver of an emergency vehicle
- These amendments went into effect on July 1, 2009.
- The Bureau of EMS is now in the rule development process regarding field internship experience in paramedic programs
